CBCG Council Adopts Draft Laws and Decisions aimed at Aligning with European Standards and Enhancing Payment System Efficiency

Today, the Council of the CBCG adopted the Decision Amending the Decision on Determining Tariff for Calculating Fees Charged for the Central Bank of Montenegro Services. The Decision, which will be applied from 1 December this year, decreases the CBCG fees charged to banks for providing its services in the RTGS and DNS payment systems by 50%. Instead of the current 0.10 euros for executing an order with a value of 1,000 euros, the fee will amount to 0.05 euros, while the fee for executing orders with a value exceeding 1,000 euros will amount to 0.75 euros instead of 1.50 euros charged now.
This creates conditions that banks transfer decrease payment service fees proportionally to ultimate beneficiaries – households and the economy, and that the effects of this measure be fully effected to the benefit of payment services beneficiaries. This amendment is a significant step towards implementing the national instant payments system (TIPS Clone), which is being developed following the technical requirements of the Eurosystem, in cooperation with the Banca d’Italia and the European Central Bank, which will eb available to Montenegrin citizens from the late July next year.
Even though the decreased fees will have an adverse effect on the CBCG revenues, this measure was assessed justified, considering wider objectives – increased efficiency, availability and competitiveness of the national payment system, along with the expected effects of lower costs for citizens and the economy.
With a view of fully aligning with the relevant EU regulations, the Council adopted today the Draft Law Amending the Law on Resolution of Credit Institutions. The key objective of the proposed amendments is to additionally improve the resolution proceeding and to adjust it to up-to-date European standards. Them main novelty relates to the introducing of clear regulatory treatment for entities for which resolution plan provides bankruptcy only, and not the resolution.
Aiming to increase legal security, transparency and efficiency in performing internal resolution, the Council adopted the Decision Amending the Decision on Detailed Content of Resolution Plans for Credit Institutions and Group Resolution Plans. This act defines the obligation of creating a separate manual that will contain a detailed description of procedures, internal rules and steps for performing the internal resolution instrument, with precise distribution of responsibilities within the credit institution, a clear plan of communicating with relevant entities, and other elements necessary for legal and timely performing of resolution measures.
With a view to full harmonisation with the relevant EU legislation, the Council also determined the Draft Law Amending the Law on Comparability of Fees Related to Consumer Payment Accounts, Payment Accounts Switching and Payment Account with Basic Features. The proposed amendments expand the scope of credit institutions which are obliged to open and maintain accounts with basic features. To wit, this obligation applies to all credit institutions with registered office in Montenegro, thus fostering wider used of accounts with basic features that include a set of benefits (free of charge account opening, maintaining and closing, free of charge outgoing payments and cash withdrawal at the teller and ATM, and ten free of charge national payment transactions monthly). It also extends the scope of clients who may open an account with basic features. In addition to current categories (beneficiaries of minimum wage, social benefits, disability benefits, health care allowance and benefits for insurance from unemployment), the beneficiaries of lowest pensions, temporary fees from the Pension and Disability Fund and child allowance will also be able to use this right.
The Council adopted the Decision Amending the Decision on Appointing the Chair and Members of the Advisory Committee, which appointed dr Marko Škreb, former Governor of the Croatian National Bank as a member of this body.
At today’s meeting, the Council also discussed and adopted other materials under its competence.
